Del. Court Awards Summary Judgment to Air & Liquid, Says Plaintiff Failed to Present Evidence of Exposure to Defendant’s Component Parts

WILMINGTON, Del. –– A Delaware court has awarded summary judgment to Air & Liquid Systems Corp. in an asbestos action, concluding that the plaintiff had failed to establish that the facts “support any permissible inference” that the plaintiff was exposed to asbestos-containing component parts for which the defendant is responsible.

In Oct. 27 opinion, the Delaware Superior Court wrote that the plaintiffs attempted to “stretch” the plaintiff’s general testimony to testimony about replacement parts.
