New York Appellate Court Affirms $9 Million Verdict Against Brake Grinder Defendant

NEW YORK –– A New York appellate court has affirmed a $9 million award against a brake grinder defendant at the conclusion of an asbestos trial, opining that the defendant had a duty to warn the plaintiff of the “latent danger arising from the foreseeable use of its product.”

In the Oct. 5 ruling, the New York Appellate Division of the First Judicial Department of the Supreme Court further found that the $9 million damage award –– a reduction by the trial court of the jury’s original $25 million verdict and stipulated to by the plaintiffs –– was appropriate.
