N.Y. Court Adopts Special Master’s Recommendation Disallowing ‘Duplicative Discovery Requests’ in Asbestos-Containing Talc Case

NEW YORK –– A New York trial court has adopted a Special Master’s recommendation in an asbestos-containing talc case, finding that the plaintiff’s Notice to Admit and Requests for Production of Documents could have, and should have, been sought from witnesses that were made available to her.

In the Oct. 27 order, the New York Supreme Court for New York County agreed with the Special Master’s assessment that the propounding of supplemental, duplicative discovery requests should be disallowed.
