N.Y. Court Denies Post-Trial Motions, Finds No Fault with Jury’s $4 Million Award in Asbestos Case

UTICA, N.Y. –– A trial court in upstate New York has denied Pacemaker Steel & Piping Co.’s post-trial motions in an asbestos case, ruling that the $4 million award entered against the defendant was not “clearly excessive.”

In the Nov. 24 order, the New York Supreme Court for Oneida County further ruled that Pacemaker was not prejudiced when it was only permitted to present testimony from two of its eight co-worker witnesses.

The plaintiffs asserted in their lawsuit that Nicholas Dominick’s work from 1968 to 1973 as an internal grinder at the Chicago Pneumatic tool manufacturing plant in New York …
