Wis. Federal Court Denies Motion to Dismiss, Allows Asbestos Plaintiff to Amend Suit

MADISON, Wis. –– A Wisconsin federal court has issued an order allowing an asbestos plaintiff to amend her suit so that she is properly substituted in as the administrator of her late husband’s estate, saying the plaintiff’s failure to do so in a timely manner was not made in bad faith.

In the Nov. 10 ruling, the U.S. District Court for the Western District of Wisconsin additionally opined that since the litigation has been going on for more than a year with a scheduled trial date, the dismissal of the claims would be inefficient.
