Hospital Files Motion to Quash Subpoena Seeking Information on Liver Donor

PITTSBURGH -- A defendant in an asbestos case has supported its request to see medical information on a plaintiff's liver donor, saying that so long as the personal information is redacted from the file, the production of such documents do not violate patient confidentiality laws. Sweeney, et al. v. Beazer East Inc., et al., No. 09-004759 (Pa. Ct. Comm. Pls., Allegheny Cty.).

The hospital that maintains the records, however, claimed in a Sept. 22 motion to quash that the request has no legitimate basis and is nothing more than a "fishing expedition."
