Statute Bars Service of Asbestos Claims Against Dissolved Businesses, Court Says

ST. PAUL, Minn. - A state appeals court has barred the asbestos personal injury claims of several workers asserted more than 16 years after the defendant company had voluntarily dissolved under the state's business corporations act. Podvin v. The Jamar Company, et al., No. C0-02-1075 (Minn. Ct. App.).

Reversing a trial court decision allowing the claims against the dissolved corporation to move forward, the Minnesota Court of Appeals said in a decision issued Jan. 14 that the personal injury claims did not fall within a exception created by Minnesota statute for liabilities incurred during dissolution proceedings.
