Pa. Superior Court Upholds Awards of Summary Judgment to Asbestos Defendants in Workplace Exposure Case

PHILADELPHIA — The Pennsylvania Superior Court has upheld awards of summary judgment to six asbestos defendants, finding the plaintiff failed to establish that the decedent was exposed to asbestos-containing products manufactured by the defendants on a frequent and regular basis.
In an Oct. 22 opinion, the court rejected plaintiff Colleen Krauss’ arguments that genuine issues of material fact exist as to whether the decedent’s workplace exposure to defendants’ products caused his fatal mesothelioma.
