CHICAGO — A federal judge has barred the exposure simulation video evidence of one plaintiff’s expert and limited the state-of-the-art testimony of another in a case filed by an Illinois man who claimed he developed lung cancer as a result of asbestos exposure.
In an Oct. 21 decision, Judge John Z. Lee of the U.S. District Court for the Northern District of Illinois held that Dr. William Longo’s videotaped experiments demonstrating certain exposure scenarios fail to correspond with the circumstances under which the plaintiff was exposed to asbestos and, therefore, may not be shown to jurors.
