General Contractor Denied Summary Judgment; Asbestos MDL Court Finds Enough Evidence of Causation

PHILADELPHIA –– The National Asbestos Products Liability Multidistrict Litigation court has denied a general contractor’s efforts to obtain summary judgment, saying that the plaintiff has presented enough evidence of causation to defeat the motion.

In the Nov. 7 decision, the U.S. District Court for the Eastern District of Pennsylvania opined that a reasonable jury could conclude that the general contractor’s conduct caused the plaintiff’s injury.

Plaintiff Corey Stewart contends that he was exposed to asbestos-containing products while working at General Tire Plant in North Carolina. Stewart named Daniel International Corp. as a defendant in the action for its role as …
