Calif. Federal Court Dismisses Declaratory Lawsuit Filed Against Asbestos Defendant Flintkote

SAN FRANCISCO –– A California federal court has dismissed a declaratory action filed by the insurer of an asbestos defendant, citing a nearly identical lawsuit that was, up until recently, pending in Delaware.

In the Nov. 21 order, the U.S. District Court for the Northern District of California opined that the insurer will have the opportunity to resolve all of the issues it brings in the instant action in the related Delaware case, which is currently on appeal.

Plaintiff Aviva PLC, formerly known as Commercial Union Assurance Company Ltd., brought the instant lawsuit.
