Utah Court Vacates Deadlines in Asbestos Case, Waits for Motion to Substitute for Deceased Plaintiff

SALT LAKE CITY, Utah –– A Utah federal court has vacated all deadlines in an asbestos case, noting that while counsel for a deceased plaintiff had yet to properly seek the addition of a new plaintiff to the action, re-working the scheduling order when the addition occurs would protect the interests of the plaintiffs.

In the Dec. 13 opinion, the U.S. District Court for the District of Utah wrote that when the plaintiff is properly added, it will establish a new scheduling order, including new discovery deadlines.
