Md. Court Denies Asbestos Plaintiffs’ Motion to Remand, Says GE’s Removal was Timely

BALTIMORE –– A Maryland federal court has denied an asbestos plaintiffs’ motion to remand, opining that the removability of the lawsuit was not apparent in the complaint.

Instead, the U.S. District Court for the District of Maryland ruled that defendant General Electric (NYSE:GE) was not put on notice of a federal question until the plaintiffs filed an answer which noted a U.S. Navy vessel on which the decedent worked.

The plaintiffs filed the lawsuit in 2008 on behalf of Ennis B. Bing, whose death was allegedly caused by exposure to asbestos. Bing was employed at Bethlehem Steel Corp., Sparrows …
