Louisiana Court Remands Secondhand, Take-Home Exposure Case

NEW ORLEANS -- A Louisiana federal court has remanded a secondhand, take-home exposure case after finding that the U.S. Navy did not have control over asbestos-related warnings at the worksite of the plaintiff's father. Francis v. Union Carbide Corp., et al., No. 11-2695 (E.D. La.).

In the Dec. 7 opinion, the U.S. District Court for the Eastern District of Louisiana concluded that there was no causal nexus between the actions of the employer taken at the direction of the U.S. Navy and the failure to warn claims asserted by the plaintiff.
