WILMINGTON, Del. -- A Delaware state court judge has issued an order sanctioning an asbestos plaintiff attorney $25,000 for his alleged misconduct when filing response briefs to summary judgment motions. In re: Asbestos Litigation; Turchen, C.A. No. 09C-11-059 ASB; Johnston, C.A. No. 09C-07-128 ASB (Del. Super. Ct., New Castle Cty.).

In the Oct. 28 order, Judge Peggy L. Ableman of the Delaware Superior Court for New Castle County found that plaintiffs' counsel misrepresented and ignored case law when filing opposition briefs and only made an effort to correct those errors when prompted to do so by the court.
