BATON ROUGE, La. -- A Louisiana appellate court has reversed an award of summary judgment entered in favor of Union Carbide, finding that the defendant had not raised the issue of medical causation in its brief and, therefore, it could not be used as grounds for dismissal. Robertson, et al. v. Doug Ashy Building Materials Inc., et al., No. 2010 CA 1551 (La. Ct. App., 1st Cir.).

In the Oct. 4 opinion, the Louisiana 1st Circuit Court of Appeal said that the plaintiff had presented sufficient evidence linking the decedent's asbestos exposure to Union Carbide's raw asbestos and that the …
