PHILADELPHIA -- The court overseeing the asbestos federal MDL has dismissed claims against a premises defendant, finding that the plaintiff had failed to prove that the defendant occupied the land with the intent to control. Lindemann v. Ohio Edison, et al., No. 07-63080 (E.D. Pa.).

In the Oct. 19 order, the U.S. District Court for the Eastern District of Pennsylvania found that during the time frame in question, there was insufficient evidence to establish that defendant Ohio Edison was operating the plant where the decedent worked.
