CLEVELAND -- An Ohio court has denied defense efforts to preclude the testimony of a plaintiff expert who was set to testify that exposure to chrysotile asbestos in friction products caused the decedent's mesothelioma. Sylvasy, et al. v. Goodyear Tire & Rubber Co., et al., No. 695277 (Ohio Ct. Comm. Pls., Cuyahoga Cty.).

In the Oct. 25 opinion, Judge Leo M. Spellacy of the Ohio Court for Common Pleas for Cuyahoga County said that the opinion of Dr. James A. Strauchen was admissible and that whether his diagnosis is correct "is up to a jury to make a determination."
