Miss. High Court Finds Complaint Barred by Statute of Limitations

JACKSON, Miss. -- The Mississippi Supreme Court has reversed the denial of a motion to dismiss, ruling that the statute of limitations had expired on a lawsuit that was originally filed by a deceased plaintiff. Garlock Sealing Technologies, et al., v. Pittman, et al., No. 2008-IA-01572-SCT (Miss. Sup. Ct.).

In the Oct. 14 opinion, the high court said that decedent's widow could not amend a complaint that related back to a filing that was a nullity.
