CLEVELAND -- An asbestos defendant and one of its insurers have filed a declaratory action seeking a judgment on whether a reallocation of defense and indemnity cost share percentages should be reallocated after a dispute with a second insurer. Arrowood Indemnity Co., et al. v. Continental Casualty Co., et al., No. 10-02084 (N.D. Ohio).

The Sept. 17 declaratory action was filed in the U.S. District Court for the Northern District of Ohio after it was discovered that an additional policy had been issued to the asbestos defendant and had not been taken into consideration when doing the allocation of costs. …
