MEMPHIS, Tenn. — A Tennessee federal judge has denied Abbott Laboratories Inc.’s (NYSE: ABT) motion for summary judgment in a Humira failure-to-warn case, ruling that the plaintiffs provided sufficient evidence that the drug maker agreed to toll the state’s statute of limitations on product liability claims.
On Dec. 6, Judge William G. Young of the U.S. District Court for the Western District of Tennessee found that an email proffered by plaintiffs is consistent with their position that Abbott had previously waived the statute of limitations defense for a specific time frame in an informal tolling agreement.
