Calif. Judge Refuses to Dismiss Punitive Damages, Warranty Claims in PFAS Class Action




SAN DIEGO — A California federal judge has refused to dismiss a class action accusing Cava Group Inc. of failing to disclose the presence of “heightened levels of organic fluorine and unsafe per-and polyfluoroalkyl substances” in the packaging of its grain and salad bowls.

In a Dec. 4 order, Judge Michael M. Anello of the U.S. District Court for the Southern District of California found Cava could have made its arguments regarding the claims for punitive damages and implied warranty in a previous motion to dismiss, and that Rule 12(g) precludes it from doing so now.
